IP Key LA shares experiences and best practices related to Non-Traditional Trademarks in Mexico

Due to the recent reform of the Industrial Property Law in Mexico, that includes the possibility of registration of non-traditional trademarks, the Mexican Institute of Intellectual property (IMPI in Spanish) and the Mexican Confederation of Industrial Chambers (CONCAMIN) held a seminar on the Recent Amendments to the Industrial Property Law on trade mark matters on September 5 in Mexico City. The event covered in-depth the reform elements, their relevance and impact, with the support of national and international stakeholders.

IP Key Latin America team invited IP expert Inmaculada González and well-known IP lawyer Thierry Van Innis, - involved in the legal process that allowed the registration of the red sole as a Loubuotin brand. González was in charge of sharing experiences in the registration of non-traditional trademarks and talking about the figure of bad faith in the trademark registration from the European perspective. She  concluded her intervention  highlighting the possibility of alleging the existence of bad faith applicant in the framework of an opposition procedure. Van Innis, meanwhile, spoke about good practices acquired by the agencies in Europe, to guide companies and entrepreneurs through the changes and implications related with the registration of non-traditional trademarks.
