Relations between trade marks and geographical indications

Based on an increasing use and awareness of the importance of protected GIs as a tool for sustainable development and prosperity, IP Key LA organized a two-day informative session to present to the relevant Latin American stakeholders, not only the existing legal framework for TMs registrations vis-à-vis GIs, but also how this is applied in practice by the competent authorities.

Participants from Colombia, Peru and Ecuador attended the sessions, to have a practical discussion with EU experts on how the conflicts between trade marks applications and opposition decisions are examined when GIs are involved and how the interests of the TM owners and the GI users are balanced.

This event focused on the relations between trade marks and geographical indications, and more in particular on the practice (examination/opposition) of the EUIPO as regards the trade marks which may be in conflict with protected GIs.
