Study visit to Europe to investigate the feasibility of China’s accession to UPOV ‘91

IP Key and Chinese experts selected by China’s Ministry of Agriculture (MoA) and China’s State Forestry Administration (SFA) (the “study team”) held a series of roundtables from July 4th-7th 2016 in Europe (Angers and Brussels) as part of an ongoing feasibility study on China’s potential accession to UPOV ’91. The Chinese study team met with European stakeholders to discuss the impacts of UPOV ’91 accession in the EU, and issues related to China’s potential accession to UPOV ’91. This informed the ongoing research conducted by the Chinese study team, expected to be completed in December 2016, about feasibility of China’s UPOV ’91 accession. The roundtables involved high-level participants from MoA, SFA, the Community Plant Variety Office (CPVO), UPOV, breeders’ associations, farmers’ associations, and academics. The activity resulted in several specific outcomes. It resulted in three concrete activities being agreed to be undertaken or seriously considered by MoA, SFA, and CPVO, namely: (1) a seminar to share experiences on CPVO’s auditing practices of the offices that provide it distinctiveness, uniformity, and stability (DUS) tests; (2) potential additional “taking over” of CPVO’s DUS testing reports by China; and (3) potential exchange of information related to treatment of essentially derived varieties (EDV), harvested material, farm saved seed, and other technical issues. Also, the activity resulted in: (4) UPOV’s continued commitment to provide a formal explanatory note in the near future on the relatively ambiguous concept of EDV; (5) Clarification, for the Chinese study team, of a number of technical issues related to legal provisions in UPOV ‘91 (e.g. exact parameters of exemptions for farmers); (6) identification of several strategies, based on European practice, that China can use to make potential accession to UPOV ’91 more politically feasible; (7) Understanding of the positive economic impact that accession to UPOV ’91 has created in the EU in terms of output, trade, innovation, and incomes of farmers; (8) Identification of a number of research studies that will help aid the Chinese study team’s research; and (9) commitment by stakeholders present at roundtables/meetings to further share information via email with IP Key and MoA and SFA related to the Chinese study team’s research. The outcomes are significant since they help build China’s capacity to accede to UPOV ’91.
