IP Key China study: Lessons from the EU experience with memoranda of understanding in tackling the online sale of counterfeit goods

Earlier this year, the IP Key China team commissioned a study to look at how applicable the memorandum of understanding approach might be to the online anti-counterfeiting drive in China. The resulting study, which was unveiled on 21 November 2019 in Haikou, draws on over 30 surveys and in-depth interviews conducted with businesses and authorities in the EU and China as well as legal cases where the China e-Commerce law has been applied.

The findings and recommendations of the research aim to add to debates around the potential role of agreements between e-Commerce platforms and rights holders while considering the role of authorities in facilitating this type of approach. The study, which is entitled Lessons from the EU experience with memoranda of understanding in tackling the online sale of counterfeit goods, is shortly due to be released online in English and Mandarin Chinese.
