EU-China Workshop on IP issues in Anti-Unfair Competition Law

The China-EU Seminar on the Reform of PRC Anti-unfair Competition Law has been co-organized by IP Key and SAIC at the School of Administration of the State Administration for Industry and Commerce in Shenzhen, Guangdong Province on June 10th, 2015 opening a series of technical training sessions for AIC officers organised by SAIC in the same week.

The seminar was addressed on the aspects as below:

· Administrative anti-unfair competition enforcement: investigation, technical expertise, acquisition/preservation of evidence, seizures, measures and fines; effective execution of orders and injunctions;

  • Protection of trade secrets: assessment of pre-requisites and evidence requirements;
  • Slavish imitation of products: protection scope and enforcement measures;
  • Fake/misleading indications of products' origin: protection scope and enforcement measures.

Judges Edger Brinkman from The Hague (NL), judge Angel Galgo-Peco from Madrid (SP), professor Christoph Ann from Munich (DE) as well as SAIC experts Mr Zhu Dewei (Jiang Yin Market Supervision Bureau) and Mr Liu Jun (Economic Inspection Section of Foshan) provided their insights and comments in a full day seminar that was followed by the third “IP café’” of IP Key, this time organized with the South China University of Technology in Guangzhou.

The event allowed discussions about unfair competition IP related issues as well as protection of trade secrets, which is one of the priorities set by the current EU China IP Dialogue.

The State Administration of Industry and Commerce (SAIC) has completed a draft revisions of the Anti-unfair Competition Law  (“AUCL”) at the end of May 2015, and is preparing to submit the draft to the State Council Legislative Affairs Office. This draft has not been released for public comments while the same might be published by SCLAO in the forthcoming months. In the future, the EU and China plan to further cooperate on this topic and share expertise in order to enhance and deepen their mutual understanding.
