Exchange on Anti-Unfair Competition Law (trade secrets) in the EU

With the revised AUCL (Anti-Unfair Competition Law of PRC) became effective on 1st January 2018 for the first time since its promulgation in 1993, IP Key China together with the State Administration of Market Regulation (SAMR) jointly organised an Exchange on Anti-Unfair Competition for strengthening the understanding of the principles and procedures of trade secrets protection as well as facilitating the effective working relationship between the EU and China. The SAMR officials, lead by Director General Li Qing, visited Germany, Luxembourg and Belgium in January 2019. During the activity, discussions were held with various stakeholders in order to discuss the new legal framework brought by the revised AUCL of China and the Trade Secrets Directive, both on the national and EU-level. Best practices and challenges regarding perspectives on trade secrets as well as enforcement measures and procedures were also discussed in detail. In Brussels, meetings were held with DG TRADE, DG GROW, DG COMP and DG JUST encompassing various related topics, such and unfair competition behavior, consumer protection, avenues for further cooperation. Both Chinese and European stakeholders confirmed their interest in on-going cooperation in these areas.
