IP Key LA and the Andean Community celebrate the publication of repositories of Andean decisions relating to trade mark and design examination

For the first time in the region, the Andean examination practice decisions for trade marks and designs are compiled in a repository that includes best practices from the four IP offices of the Andean Community (CAN) region, in relation to trade mark and design examination and the decisions of the Andean Tribunal of Justice when interpreting the operational application of Decision 486.

These repositories are published and freely accessible to IP office examiners and IP users who seek reference and predictability in relation to examination decisions made by the different authorities of the Andean countries.

These documents will help identify best examination practices from the Andean countries’ IP offices and harmonise the criteria used prior to making decisions granting or refusing trade mark or design applications.

The repositories include a specific chapter on EUIPO practice which invites readers to access a link to the EUIPO guidelines and refers to the possible areas where the practices of the EU and CAN regions overlap.
