This activity entails the organisation of workshops to promote the convergence of practices and exchange information on issues of pressing concern to EU businesses operating in SEA, including bad faith applications, protection of well-known marks, and the impact of new technology on the examination of trade marks and industrial design applications.
Following the enactment of the Amended IP Law of Viet Nam, which took effect on 1 January 2023, with provisions on sound marks protection from 14 January 2023, and the protection of test data for agricultural chemicals effective on 14 January 2024, the activity organises events to promote awareness and ensure that EU and SEA businesses operating in Viet Nam are aware of the changes under the new law.
The activity is aimed at continuing to raise awareness on plant variety protection and the benefits of the UPOV 1991 Act. The seminar focuses on the importance of plant variety protection to address concerns regarding food security and climate change, as well as to promote a better understanding of the issues relevant to strengthening PVP systems and UPOV 1991 Act membership.
Following the model and methodology adopted by the EUIPO, through the European Observatory on Infringements of Intellectual Property Rights, in preparing the Analysis Report on IPR-intensive Industries and Economic Performance in the European Union, the study aims to provide an assessment of the combined contribution of industries that make intensive use of the various types of IPRs to the economy of interested SEA countries.
Following the conclusion of Free Trade Agreements with Singapore and Viet Nam, the IP Key SEA Phase II Action continues to provide support and assistance for the implementation of the IPR-related commitments undertaken by the SEA countries. To define specific activities, consultations are conducted with the relevant government agencies and stakeholders. Indicative activities include studies, seminars, and peer-to-peer meetings that help to identify the technical needs of SEA countries and facilitate the implementation of their FTA commitments.
As the IP Key SEA Phase II Action is designed to facilitate bilateral trade agreement negotiations and IP Dialogues, the project continues to provide technical expertise and assistance geared towards strengthening knowledge-based policy making in the SEA countries through the conduct of IP studies and other forms of assistance as may be needed. This activity covers initiatives identified with trade agreement partner countries in SEA, such as reports, studies, seminars, or meetings, among others, which can be useful in ensuring positive results from the negotiations and dialogues.
This activity will consist of carrying out a study that will propose changes to the Peruvian legislation on copyright, based on EU legislation, so that it could serve the authorities to effectively combat copyright infringements in the digital environment.
The study will consider recent legislative changes in other countries, with a specific focus on examples like Uruguay. The study will take into account the recent legislative changes made in Uruguay, which allow authorities to take proactive measures to effectively combat infringements of copyright and related rights.
The objective of this activity is to share best practices in the enforcement of copyright infringements, especially those involving cooperation between local authorities defending IP rights, and even cases where there is cooperation between different countries.
As a follow-up to previous activities, it will provide an opportunity for enforcement authorities in Chile, Paraguay, and Brazil to share their experiences with each other regarding practices and tools used to effectively detect and combat IPR infringements in online environments.
The activity consists of a 1-day hybrid seminar in Sao Paulo, where most companies and platforms have their operations in Brazil, gathering enforcement authorities in Brazil, representatives of e-commerce and EU companies/rights holders.
