Promoting Creativity and Innovation: The Amended IP Law of Viet Nam

Following the enactment of the Amended IP Law of Viet Nam, which took effect on 1 January 2023, with provisions on sound marks protection from 14 January 2023, and the protection of test data for agricultural chemicals effective on 14 January 2024, the activity organises events to promote awareness and ensure that EU and SEA businesses operating in Viet Nam are aware of the changes under the new law.

Awareness Raising on Plant Variety Rights Protection

The activity is aimed at continuing to raise awareness on plant variety protection and the benefits of the UPOV 1991 Act. Study on the Economic Impact of IP in the SEA Countries

Following the model and methodology adopted by the EUIPO, through the European Observatory on Infringements of Intellectual Property Rights, in preparing the Analysis Report on IPR-intensive Industries and Economic Performance in the European Union, the study aims to provide an assessment of the combined contribution of industries that make intensive use of the various types of IPRs to the economy of interested SEA countries.

Support and Assistance for the Implementation of Free Trade Agreements

Following the conclusion of Free Trade Agreements with Singapore and Viet Nam, the IP Key SEA Phase II Action continues to provide support and assistance for the implementation of the IPR-related commitments undertaken by the SEA countries. To define specific activities, consultations are conducted with the relevant government agencies and stakeholders. Indicative activities include studies, seminars, and peer-to-peer meetings that help to identify the technical needs of SEA countries and facilitate the implementation of their FTA commitments.

Technical Expertise and Assistance for Bilateral Trade Agreement Negotiations and IP Dialogues

As the IP Key SEA Phase II Action is designed to facilitate bilateral trade agreement negotiations and IP Dialogues, the project continues to provide technical expertise and assistance geared towards strengthening knowledge-based policy making in the SEA countries through the conduct of IP studies and other forms of assistance as may be needed. This activity covers initiatives identified with trade agreement partner countries in SEA, such as reports, studies, seminars, or meetings, among others, which can be useful in ensuring positive results from the negotiations and dialogues.

Study for the improvement of regulations in copyright law regarding compliance in the digital environment

This activity will consist of carrying out a study that will propose changes to the Peruvian legislation on copyright, based on EU legislation, so that it could serve the authorities to effectively combat copyright infringements in the digital environment.

The study will consider recent legislative changes in other countries, with a specific focus on examples like Uruguay. The study will take into account the recent legislative changes made in Uruguay, which allow authorities to take proactive measures to effectively combat infringements of copyright and related rights.

Exchange Programs – IP and Cyber Crime (Operation 404)

The objective of this activity is to share best practices in the enforcement of copyright infringements, especially those involving cooperation between local authorities defending IP rights, and even cases where there is cooperation between different countries.

As a follow-up to previous activities, it will provide an opportunity for enforcement authorities in Chile, Paraguay, and Brazil to share their experiences with each other regarding practices and tools used to effectively detect and combat IPR infringements in online environments.

The activity consists of a 1-day hybrid seminar in Sao Paulo, where most companies and platforms have their operations in Brazil, gathering enforcement authorities in Brazil, representatives of e-commerce and EU companies/rights holders.

The seminar will focus in particular on the sale of counterfeit goods on the internet and best practices related to it.

Regional seminar on enforcement for IP Prosecutors, Customs and Police Investigators in Costa Rica

This seminar consists on a 3-day in-person seminar to be organised jointly by WIPO, USPTO, the Japan Patent Office and the Directorate General of Intellectual Property of Costa Rica. The activity will train prosecutors, customs, and police investigators from Central America and Mexico on effectively dealing with IP crime.

The seminar will be divided into four parts, focusing in particular on:

  • Prosecuting IP crime
  • Investigating IP crimes
  • IP enforcement at the border
  • Right Holders Exhibition.
